A Concerned and Disappointed American!!!!

More and more it seems this world we live in is becoming more on edge and agitated. I am by far no Ph. D. in Political Science, far from it. However, I am a concerned American who has become very disappointed with the image we have in the world's eyes. I think we would be very hard pressed to go to any country and ask the every day citizen what their perception of America is and find a majority that would be favorable. There are many issues I may not agree with President Obama on, however, his views of meeting on common ground and being diplomatic when dealing with the world I do think are essential to our success. I think in the state that we have fallen to as not being the great producer we once were puts us in a position whereby we must accept that the playing field is becoming more level as each decade passes. We must come to grips with the idea that the day approaches when we will not be able to negotiate with guns or check books in our hands. China is a perfect example. With a 2 trillion dollar surplus of cash and a 1 million man army, we can't just "strong arm" them and push them around, so we must implore more diplomacy. I am not saying fear them by any means, we must simply use more diplomacy sometimes. Just a couple of years ago at the United Nations Venezuelan President, Hugo Chavez referred to our then President George Bush the younger as the Devil. As the cameras panned the audience, many dignitaries from the represented countries were applauding before they quickly cued from them back to the speaker. If this is the growing sentiment of the world's countries, we cannot have them thinking they are on God's side in a holy war against us. This is why I have paid very close attention to the Raymond Davis case!

My interest isn't in his guilt or innocence of the shooting. It seems that his diplomatic status is what's important. Quite naturally, the Pakistani government is saying that he doesn't have diplomatic immunity and the government is saying he does. In this situation we know that someone is not telling the truth. This is what troubles me, in some of the articles I've read, it seems that America is threatening to withdraw the 2 billion dollar annual funding to Pakistan to aid in their war with Afghanistan. Again, negotiating with a check book in hand, if Pakistan doesn't hand over Raymond Davis. On the other end of the equation, if Pakistan does hand him over, they face nation-wide, civil unrest as had Egypt the last couple of weeks. I think in either direction this whole mess turns out, it is safe to say the people of Pakistan and other countries in that area of the world will take an even more negative stance against the United States.

This whole media frenzy over detaining those who have diplomatic immunity gave me a flash back to a 2002 media frenzy over H.E. Diplomat Consul-General Dr. Malachi Z. York-El. To bring the reader up to speed, Rev. Dr. Malachi K. York, is a Consul-General of Liberia, Africa. In 2002, he was arrested in Milledgeville, GA, on charges of child molestation and transporting children across state lines for the purpose of engaging in illicit acts with them(Mann Act). Interestingly enough, he was proven innocent of all those charges in federal court. After that first attempt to incarcerate him was defeated, the prosecution trumped up a RICO charge which he was proven to be innocent of also and was still put in prison, the most isolated prison in the United States might I add, Florence AD MAX, in Florence, CO.

Now, how does this look to the world? We have a person who supposedly has diplomatic immunity, that has gone to another country and killed two people, allegedly in self-defense with an alleged un-registered gun. He was allegedly in an area that was restricted. He was allegedly spying. He makes a call to the consul for a speedy evacuation and the extractors run a native over and kill him on the way to get the alleged murderer. In support of our own, we quickly put pressure on the home government to release our fellow citizen for a speedy return back to the United States, which I agree we should do for one of ours first and foremost. Again, how does this look if we demand the Vienna Convention Treaty's codes and articles are observed for one of ours and we turn around and violate them ourselves??

With all that, we can hold Diplomat Consul-General Rev. Dr. Malachi K. York, who made it clear to the arresting officers of his status. Not only that, he presented his foreign dignitary card, Diplomatic Passport Number: D/003828-04, and his Liberian Permit of Residence- permit number: 108208, and was still arrested and detained. When Dr. York was arrested, Article 31 of the Vienna Convention on Diplomatic Relations and Article 41 and Article 3 of the Vienna Convention on Consular Relations was violated. When he was denied the right to have his consular notified, Article 36 of the Vienna Convention on Consular Relations was violated as well. It must be stated that we cannot continue to show a blatant system of double standards and expect to be respected as the world police of democracy and justice for all on a world-wide scale. After expressing this, I hope the reader can understand why I am a now more concerned and disappointed American!!!!

If The Evidence Proved Him Innocent, Why Did Malachi York Plea Guilty?

This very seemingly simple question has a quite complex answer. Unbeknown to many outside of the judicial system, this phenomenon occurs much more often than one would think. This holds ever so true even more for the offender or suspected offender that cannot afford a good attorney. A court "appointed" attorney is a court "paid" attorney. Now, if you couple this with the idea of a person who may already have any kind of criminal record, you have a recipe for many people being put behind bars on false pretenses.

Question: It is impossible that someone would ruin their life because of a terrible lawyer, is there more to it?

Answer: Yes there is.

Many times, the terror begins in the 'inTERRORgation' room. This is where investigators use all kinds of physical and psychological tortures to coerce(force, trick) a person into confessing to a crime they didn't commit or even being an accessory. Often times, just as depicted on the detective shows that come on television(tell-lies-to-your-vision), the interrogation process is for the most part the same just much more harsh. An interrogation may last three to four days for hours on end and the suspect is kept up and deprived of sleep, food, and bathroom breaks. The investigators rotate out and are well rested and keep reminding the suspect of all the time they are facing. They ask the same questions over and over. All it takes is one inconsistent answer and its all but over for the suspect. For example,"What time did you leave the party." If the suspect repeatedly says 10:15, they will keep you up for hours on end for days. Remember, the may have allowed the suspect a couple of hours of sleep over the last two days. Meanwhile, they are bringing well rested interrogators in like a relay team. The suspect is in an often cold, uncomfortable room, sitting on a steel chair. They will keep asking, "Are you sure it was 10:15, are you sure it wasn't 10:35? If you are deprived of sleep, and you slip up and say maybe, they will never let you live that down and say you lied to us. "You said you left at 10:15, now you're saying 10:35, you know you just f----- up right?" It's pretty much all down hill from there. Next question is, "What else have you lied about?" I think the reader should have a better sense of how these interrogation techniques can get a confession from someone, even if they are innocent by now. I strongly suggest that everyone has a lawyer on retention that will have your best interest at hand to protect your rights from the beginning of your arrest, be it false or not, this is very important.

Question: Is there more?

Answer: Sadly enough, yes there is.

The reasoning behind the plea agreement is as such: If an offender takes responsibility for their crimes and owns up to it, we will not punish them as harshly. If you don't own up to your crime and make us waste our time and money going to trial and you(WILL PROBABLY LOSE LOOKING AT THE EVIDENCE, KNOW WHAT WE MEAN) lose, we will give you a more harsh punishment. As stated earlier, a court "appointed" lawyer, is a court "paid" lawyer who does what he/she is told by the court. This is a very important component of the Prison Industrial Complex system. No matter what happens to the person being tried, the court appointed lawyer gets paid regardless. It is similar to a stock broker who gets paid whether your investments that he or she recommended you to take in the first place win, lose, or break even. With this reward system in place, human nature takes over. So how many will really fight for you, knowing they will get paid whether you got to jail or not? Ultimately, the Prison Industrial Complex needs bodies for fuel whether they are innocent or not.

Understand, that these statistics go up even more for Negroid Men in America, especially from crime ridden areas. More and more, stories are being brought to light about men, especially Negroid Men, being exonerated of crimes by way of DNA evidence. There are many cases that have been recorded that show a rash of Negroid Men having been arrested from no evidence and eye witness accounts and didn't even fit the description. It's basically, "An Any Old Black Man Will Do Attitude." A study undertaken by the Innocence Project on April 14, 2009, revealed some eye-opening results. The first exoneration by way of DNA evidence happened in 1989. Since then, there have been 235 DNA evidence exonerations. 140 of these were Negroid men as opposed to 64 Caucasoid men. Before the next question, let's take a look at some of the factors that may lead to wrongful convictions: (1) 3% Mistaken I.D. (2) 21% Informant/Snitches (3) 21% False Confessions (4) 35% Hair Comparisons (5) 101% DNA Inclusion At The Time Of Trial. It should also be noted that even DNA evidence can be fabricated as well.

Question: So how does this tie into Rev. Dr. Malachi K. York?

Answer: On so many levels it does tie into Dr. York. However, his case is much more complex and has so many more dynamics to be added to the mixture. One thing that should be duly noted is that his case was not about the alleged crimes of child molestation or that of racketeering. His case was more of a war of right against wrong. For many of the injustices that I have mentioned in this very article are things he was fighting to see come to an end, not only in America, but world over. The reader should really digest the idea that when Dr. York erected the Egyptian village called, 'Tama-RE, Egypt of the West', in Eatonton, Ga, that was not only an expression of his right to practice any faith, religion, or way of life he chose as long as he was not breaking the law, he was going against the grain of a system that has long been in place of abuse and oppression. So it must be stated that as he was pursuing his rights as an individual, he was also teaching others to become self- sufficient, doers, and thinkers. As people were becoming more productive members of society, The Prison Industrial Complex was losing the fuel of uninformed, shiftless people that it needs to survive.

Question: So why would someone of such high morals, ideals, resources, and intellect plea guilty?

Answer: As I stated earlier, this was a very complex case to begin with and I will do my best to explain. Rev. York knew he was wanted removed dead or alive by a lot of different people and entities for personal, business, and religious reasons as well. With that in mind let me begin.

1. Dr. York, at the time of his arrest, was accompanied by three women. One of which was his wife, who suffers from Multiple Sclerosis. Rev. York was being told that she was not receiving the medical treatment that she needs for her ailment. Multiple Sclerosis is an illness that attacks the brain and can leave the person crippled for life if untreated.

2. Rev. York received ineffectiveness of counsel. His lawyers at the time were Manny Aurora and Ed Garland, of Garland, Samuel, and Loeb. It should be noted Ed Garland has a reputation for talking his clients into taking a plea deal, serving them up on a platter to the Prison Industrial Complex. True to form, he did the thing to Rev. York.

3. Dr. York has a medical condition himself, known as Angioedema. This ailment causes the air passages to swell and IS TRIGGERED BY STRESS AND CAN BE FATAL IF LEFT UNTREATED. It has been well documented that Dr. York has not received the medical treatment he needs to this day, after almost 9 of incarceration.

4. Rev. DR. Malachi K. York was also interrogated for hours on end, deprived of sleep, given bathroom privileges once every three days, placed in over crowded cells, and forced to sleep on floors with true, hardened criminals, murderers and drug dealers and the likes for 6 months straight. This abuse started from the time of his illegal arrest on May 8, 2002, all the way up to his illegal plea agreement on January 24, 2003. I will remind the reader to keep in mind that he was 57 years old at the time when all this was going on!!!!

5. DR. York was being told that the three women would spend the rest of their lives in prison, never to see their children again and it was all because of him.

6. His attorney Garland, told him to take the plea, it was no way he could win the case, take the plea and let the women go and be with their children and families, it's you that they really want. If you were my son I would tell you the same thing.

7. DR. York is also a Diplomat, Consul-General, Head of the Consulate Post for the Republic of Liberia, West Africa. Dr. York repeatedly informed the arresting officers during their illegal arrest and kidnapping who he is and that he has Diplomatic Identification and Passport Number: D/003828-04. They only replied to him by saying, "Shut the F*&# UP." Let me take this time to point out that these were county sheriffs and police officers violating international laws, namely Article 36 of the Vienna Convention on Consular Relations.

8. So with all this, seemingly the weight of the world on his shoulders, Rev. Dr. Malachi Kobina York took the plea deal, which was if he would plea guilty, the women who were with him that day would be set free.

As one can see by this article, there is a lot more than meets the eye as to why someone would plea guilty and they were innocent, so please don't be so quick to judge. As stated earlier, I strongly suggest that everyone who reads this article go out at your earliest convenience and retain a lawyer that will have your best interest at hand for any legal problems you may encounter in the future. I hope I have answered your questions and have given you a clearer understanding of the reason why this happens so many times.

Sheriff Sills and the Eatonton Pact Against the Nuwaupians

It appears that Sheriff Sills has a knack for obtaining methods to fault the Nuwaupian organization for every little thing that happens! In an advertising placed in The Monticello News, Vol. 120, No. 48, Page 9, Dec. 3, 1998 Version, by Brenda Williams, a Concerned Citizen of Eatonton, indicated her views at the time of the unfair remedy of the Nuwaupians by Sheriff Sills. Ms. Williams believed a need to convey how she believed regarding the racist and biased remedy of the Nuwaupians by Sheriff Sills to inform the open public the other aspect of the narrative from what these folks had been drive fed from|the puppetized nearby and neighboring newspapers who are controlled by Sheriff Sills' command. Ms. Williams openly admitted to composing the write-up and that she was not in communication in any way with the Nuwaupians.

Apparently somebody required the write-up and e-mailed it to various news agencies, magazines, and newspapers world- over via the internet. On Dec. 4, 1998, in a swift reaction to the write-up, The Union Recorder showcased two headline content articles in big daring letters and colour pictures. One was entitled "Mass Email To Media Targets Sills-Internet Message Includes Fake Newspaper Masthead" created by Judy Bailey. The other write-up was "Sills: Article Has Gone Way Too Far," created by Jena Frazier. As acknowledged previously, Ms Williams was the creator of the write-up, that she openly admitted. Correct to form, in the second column, second paragraph of Judy Bailey's write-up it reads "Ga Press Association Attorney David E. Hudson stated, “The mock daily news violates a state copyright law. I consider if these folks stand for as the legal organ..." See the game? If Brenda Williams wrote up the write-up, why did David Hudson say "They", when Brenda Williams is an individual? This is an additional way of falsely implicating the Nuwaupians as the origin of the write-up, to simply possess an additional reason to assault them with racism and hate.

Brenda Williams was practicing her privilege and suitable as an United states citizen to communicate her opinion. Yet, the Eatonton "Pact" insists upon naming the Nuwaupians as the source. Why did Jena Frazier, author for The Union- Recorder, contact Mr. Thomas Chism, the Spokesman for the Eatonton branch, and ask him if he recognized every little thing regarding the write-up, if Ms. Williams acknowledged in the write-up that she wrote up it? It should be quite simple to see, if Mr. Chism, the Spokesman for the Nuwaupians informed her the Nuwaupians had nothing at all to do with it, that could possess been it, suitable? Nevertheless, the implication was even now put in the newspaper; this is what is meant by biased, one-sided reporting.

How Dr. Malachi K. York... Touched Me

My name is David Christopher Barnes; I am an African black male in America also a resident. Born and raised in Bowie, Maryland in the county of “Prince Georges” in the Washington, D.C. area. My age is thirty and I have been a member of “The Ancient Egiptian Order” for eleven years going on now.

June 26, 1999 in Eatonton, Georgia was the first time I came in contact with Dr. Malachi York? It was during our annual tribal New Year celebration called “The Zed Festival”. It was a cultural event that changed my life for the good. I was nineteen years of age when my eyes started opening to see my true purpose in this world. And the writings of Dr. York assisted me totally genuine inspiration of positivity, awareness, and truth.

During the celebration Mr. York came up to me and a couple of friends who came from Washington, DC also for the event. He knew it was our first time interacting with him. This man carries such a beautiful prescience, everyone was happy! We asked him for a quick picture with him and he agreed. He also asked me where I was from. His last words to me were no matter what belief, race, creed, or religious practice, respect one another. I asked how? Dr. York replied back with love and believes that to be so true in my eyes.

My family really started seeing a better me after I came back from “Tama-Re Egipt of The West”. And if it were not for the teachings of Dr.Malachi K.York, maybe I wouldn’t be writing you this essay in response to his freedom. Being touched by an angelic being is how Dr. York made me feel, all negativity was abolished from my mind. Letting me know deep down in my soul everything will be alright in life!

Bogus Indictment

Dr. Malachi Kobina York, a Ghanaian born national and a Liberian diplomat, has been wrongfully convicted and sentenced to 135 years in federal prison. I am one who stands firmly for his innocence because I have been exposed to the facts of the case. After the arrest of Dr. York, it was stated in open court that Dr. York couldn't get a fair trial in the middle district, Macon, Ga., because of the pre-trail publicity. This means that the pool of potential jurors have been exposed to all the publicity of Dr. York's case and would be biased because of it. but this same jury pool, from which the grand jury was selected from, brought forth an indictment and a superseding indictment. The job of the grand Jury is to review the facts presented to them and make a determination whether there is grounds for criminal charges. It would stand to reason that if the courts deemed that the jury pool was tainted, the grand jury from that same jury pool was tainted. This is an example of how Dr. York was railroaded!

MALACHI YORK IS INNOCENT!!!

I have studied the case of Dr. Malachi Kobina York from beginning until this present day. I have come to no other conclusion than that this great man has been a victim of an elaborate conspiracy. From the indictment, the superseding indictment, the pre-trial hearings, the trial, the post-trial hearings, the appeal, the writs, etc., it is very clear the judicial biasness and the blatant disregard for the law. I plan to outline some of the major instances where Dr. Malachi York has been robbed of his inalienable rights!
